By According to TMZ, Joi Dickerson-Neal filed a sexual assault lawsuit against Diddy, alleging that the rapper drugged and sexually assaulted her in 1991. Diddy is attempting to have several of the claims against him dismissed.
According to new documents obtained by TMZ, Diddy’s legal team argues that Dickerson-Neal cannot sue him under certain laws that were not in effect at the time of the alleged incident.
Specifically, they contest her claims under the New York Services for Victims of Human Trafficking Law (passed in 2007), the New York State Revenge Porn Law (codified in 2019), the New York City Victims of Gender-Motivated Violence Protection Law (passed in 2000), and the 2016 NYC Revenge Porn Law.
Diddy’s lawyers are calling for these specific claims to be dismissed with prejudice, while maintaining that their client did not commit the alleged acts, including the sexual assault Dickerson-Neal claims to have endured.
However, they are not making the same argument against the first two counts, which are common law claims for assault and battery and intentional infliction of emotional distress, as these do not rely on specific statutes and are at the heart of her case.
In addition to the other legal arguments, Diddy’s legal team is asserting that Joi’s attempt to sue Bad Boy Records and Bad Boy Entertainment is invalid, as these entities were not established at the time of the alleged dispute.
